According to the NYDEC, soil tests for the facility are in acceptable limits under the law. 90% of the property is paved and impervious to rain water. The NYDEC fails to note that during steady rain, water flows off the property to the south, often past the storm drains and into the neighborhood. The NYDEC has never tested the soil and sediment that collects along the curb of the residential properties to the south of the plant....... Cancer rates south of the plant are higher than average. To date, no regulatory agency has taken soil samples in the neighborhood that receives storm runoff from the plant.

The EPA, NYDEC, Town of Babylon and Village of Lindenhurst were made aware of a potential leak or spill at the plant more than 6 months ago. The official conclusion by the Town of Babylon was that this was rust from an aluminum rolled roof flowing into the storm drain. Today, the area near the tanks still looks like this. No tests of soil, no tests of groundwater. This plant has is considered to be safe......
